The Justices seem to want to avoid a major decision about whether Trump can serve as President—but if they do so they may set off a national crisis. Photograph by Julia Nikhinson / Getty On Thursday, the Supreme Court heard arguments about whether Donald Trump should be disqualified from the Presidency for the part he played in the Capitol riot of January 6, 2021. Jeannie Suk Gersen had a seat inside, and writes that although “the courtroom seemed to vibrate with the historical significance of the moment,” there soon became little reason to doubt that the Justices would eventually decide in Trump’s favor. “The suspense is over the grounds of the decision,” she writes, “which will carry enormous consequences for how the next year unfolds in this country.” It may all come down to whether the Court decides to weigh in on a larger question—not if Trump should be barred from appearing on Presidential ballots but whether he had engaged in an insurrection against the United States.
